BFC Asesores, S.C. (hereinafter “BFC Asesores”) is a sociedad civil organized in in
accordance with the laws of Mexico.
In compliance with the current legal provisions of the Federal Law for
the Prevention and Identification of Transactions with Resources of Unlawful
Origin , BFC Asesores is
obliged to collect from its Clients, as well as any other person who has an interest
in starting or maintaining a legal relationship with BFC Asesores, identity documentation and information, including:
dame, domicile, nationality, telephone, email, Sole Population Registry
Number (CURP), Federal Taxpayer ID (RFC); and collect copies of identity
documents (Voting ID issued by the National Electoral Institute, Passport, Military
Certificate or Professional ID Certificate with photo), document evidencing
domicile, public deeds evidencing incorporation and appointment of legal
representatives, among others (hereinafter the Personal Data), to comply with what is established in the Law.
Our Privacy Notice ensures
that any information and document delivered to is by any of our Clients as well as any other person who has an interest
in starting or maintaining a legal relationship with BFC Asesores, shall
be kept private and safe. In consequence, this document establishes the details of what
information may be collected by us, how do we collect it, how do we use it and
the means for our Clients, as well
as any other person who has an interest in starting or maintaining a legal
relationship with BFC Asesores, to exercise their rights of
access, correction, cancellation and opposition (ARCO Rights) in accordance with the Federal Law of Protection of Personal Data in
the Possession of Private Parties and their Regulations.
In order for you to have
full control and decision over your Personal Data, we advise you to carefully
read the following information. You will have access at all times to this
Privacy Notice. It shall be deemed that our Clients, as well as any other person
who has an interest in starting or maintaining a legal relationship with BFC Asesores, grant their tacit consent for the treatment of their Personal Data, if they do not communicate their opposition once that this this Privacy Notice has been made available.

www.bfcasesores.com Purposes and Use of your personal data BFC Asesores shall perform treatment of any collected Personal Data, specially
including those of legal, financial, or patrimonial nature, if any, for the
following purposes:
Forming
an identity file of each of our Clients, in accordance with the current laws;
Forming
an identity file of each person who has an interest in starting or maintaining a legal
relationship with BFC Asesores;
Carrying
out all acts that the Client requests to BFC Asesores in terms of the agreed
services;
Comply with the obligations acquired
with our Clients;
Evaluate the quality of
the services provided by BFC
Asesores;
Address
requirements from any competent authorities;
Carrying
out inquiries, investigations and reviews relating to any claim or complaint;
and
Carrying
out any complimentary or ancillary activity needed to perform the
abovementioned purposes.
The treatment of Personal Data shall take place as necessary, convenient and/or relevant for the
compliance with the purposes established in this Privacy Notice, as well as for
any different purposes that are compatible or analogous to those established
in this Privacy Notice.
What Personal Data is collected and where?
For the purposes established in this Privacy Notice, the Personal Data collected or to be collected, may include without limitation, the following:
General Data: full name, address, telephone, marital status, signature, electronic
signature, email, Ip address, Federal Taxpayer ID, date and place of birth, age,
names of relatives and beneficiaries, among others.
Labor Data: occupation, position, area or department, domicile, telephone, email, labor,
personal and commercial references, among others.
Financial or Patrimonial Data: bank accounts, real and movable property, credit
records, income and expenses, insurance, afores, bonds, contracted services, among
others.
In accordance with the applicable legal provisions, BFC Asesores may collect certain personal
data through public sources of data, such as Internet, telephone, or labor
databases, or any other means de public information.
Exercise of ARCO Rights (access, correction,
cancellation and opposition).
You have the right to: (i) access to the Personal Data in our possession and to the details of
their treatment; (ii) to rectify them in case of being inaccurate or
incomplete; (iii) to cancel them in the event of considering them not
necessary for any of the purposes indicated in this Privacy Notice, or if the
same are being used for purposes not agreed upon or if the contract
relationship or service relationship has ended, or otherwise, (iv) oppose to
their treatment for specific purposes.
The exercise of such rights shall be made through the delivery of a

Asesores through its representative mentioned in Section II above.
Your request shall contain the following information:
a. Name and
surname, address, address de email (or any other means to receive the
response to your request), date of birth and telephone number, attaching a copy of an official identification;b. In case of the legal representative of another
individual or legal entity, attach a copy of the document that evidences him/her
as such;c. Clear and precise description of the Personal Data with respect to which you intend to exercise any of
the abovementioned rights;d. Any other element or document that facilitates the
location of the Personal Data;e. Clear and precise description of que right you
intend to exercise, legal basis and for what purposes; andf. In case of request forrectification of Personal Data, you shall describe
the modifications to be made and provide the documents that support your
request.
The
terms for us to address your request are:
a. The
response shall be communicated in a term not to exceed twenty (20) days
following the date of receipt of your request for access, correction, cancellation,
or opposition. b. Thea
decision, if favorable, shall be made effective within fifteen (15) days following
the date of the notice informing the response described under item a. above.
The
above-described terms may be extended by BFC
Asesores on a single occasion for the same period, provided that
such extension is justified by the circumstances of the case and such
extension is informed in writing to the requesting party.
BFC Asesores may deny the
exercise of the rights of access, correction, cancellation, or opposition to
the treatment of Personal Data, in the following events: a. If the
requesting party no sea the owner of the Personal Data, or his/her/their legal
representative or has not provided sufficient evidence;b. If its
database does not contain the Personal
Data of the requesting party;c. To avoid
damaging the rights of a third party;d. In case of a legal impediment, or in case of a resolution from
a competent authority, which restricts the access to such Personal Data, or impedes the
rectification, cancellation or opposition of the same; ande. Whenever the rectification,
cancellation or opposition to such Personal Data has taken place before.f. Whenever the
request for cancellation contravenes the provisions of article 26 of the Federal Law for the Protection of Personal Data in
Possession of Private Parties;
The
refusal referred in the previous paragraph may be partial, in which case BFC Asesores shall execute the access,
correction, cancellation or opposition in the corresponding portion requested
by the owner.
In
all of the above cases, BFC Asesores shall inform the motives for its decision and communicate it to the owner of
the Personal Data or, in its case, to their legal representative, within the
terms established for such purposes, through the means indicated in the
request, accompanying, in its case, any suitable evidence.
For any additional information, please contact the person in charge, from BFC Asesores, of the
protection of your Personal Data in
accordance with the provisions of Section II above. Revocation of Consent for the Treatment of your
Personal Data The owners of Personal Data, at all times may choose to
limit the use or disclosure of their Personal Data or to revoke their consent
to treat their Personal Data, in the understanding that all treatment of Personal Data shall be subject to the consent of its owner, except for the exceptions
provided under the Federal Law for the Protection of Personal Data in
Possession of Private Parties.
To exercise any of such rights, you should
file the corresponding request through the person in charge of the protection
your Personal Data of BFC Asesores, in accordance with the provisions of Section II of this Privacy Notice.
Your request shall be accompanied with the following information:
a. Name and
surname, address, email, place of birth, and telephone, attaching a copy of an official identification;b. In case of legal representative, attach a copy of
the document that evidences it as such;c. Clear and precise description of los personal data subject
of the request to discontinue the use, for which you may refer to all your
personal data; d. Any other element or document that facilitates the
location of the personal data; ande. The request shall be dulysigned in original by the owner of the Personal Data.
Within a term not to exceed from twenty (20) days we shall address
your request and inform you of any favorable outcome through the means
indicated in your request.
Transference of Personal Data.
To comply with the purposes established in this
Privacy Notice, as well as with any other purposes that are compatible or
analogous, BFC Asesores requires to make certain transfers of the Personal Data of our Clients within, and even outside of the Mexican Republic. BFC Asesores is responsible for the transfer of Personal Data made by its officers, who
hereby agree to observe all the legal principles of protection regarding
their transfer and hereby states its commitment to respect at all times this
Privacy Notice.
As a result of this Privacy Notice, the owner hereby
agrees to the transfer of their Personal
Data in the terms described in
this Privacy Notice.
The person responsible who transfers the Personal Data of one or more owners shall communicate this Privacy Notice and the
purposes to which the owner subjected their treatment, and the third-party
recipient shall assume the same responsibilities as those of the person
responsible who transferred the data, and therefore the treatment of Personal Data shall be made in accordance with this Privacy Notice.
We hereby agree not to transfer your Personal Data to third parties without your consent,
except for the exceptions provided under article 37 of the Federal Law of
Protection of Personal Data in the Possession of Private Parties, as well as to
execute such transfer in accordance with the terms established by such law.
If you do not state your opposition for your Personal Data to be transferred, it
shall be understood that you have granted your tacit consent. The opposition may
be communicated to the Person Responsible for the protection of your Personal Data, in accordance with the provisions of Section II above.
In the event of a sale, merger, consolidation, change of control,
material transfer of assets, reorganization, or liquidation of BFC Asesores, then, at our sole
discretion, we may transfer or assign the information collected to one or
more relevant parties. The foregoing without changing the use given to the Personal Data in possession of BFC Asesores.
Modifications
to the Privacy Notice
We reserve the right to make at any time modifications or updates to this
Privacy Notice, to address changes to the applicable laws, internal policies
or new requirements for the provision or offer of our services or products.
Such modifications shall be available to the public
and our Clients and Users though the means established
in this Privacy Notice.
Safety
and Storage BFC Asesores shall perform
anything within its reach to protect the privacy of the Personal Data collected or stored from
our Clients and Users. Nevertheless, the case may be that because
of judicial orders or regulations, BFC Asesores becomes obliged to disclose Personal
Data to authorities or third parties, or otherwise, in certain cases outside
the control of BFC Asesores, third
parties may intercept or access to certain information or transmissions of data,
in which case BFC Asesores shall not
be responsible for any information unlawfully disclosed or stolen in any of
such manners. In such event, BFC Asesores will inform this
circumstance to the owner of the Personal
Data as soon as it becomes aware of such event.
